The Federal Maritime Commission (FMC) issued an Order providing, among other things, that, when determining civil penalties, the Commission
is without authority to consider subsequent violations by the respondent.
The Shipping Act of 1984, as amended, allows the Commission, when determining civil penalties, to consider 'such other matters as justice may
