Collision with Breakaway Barges

Maritime Activity Reports, Inc.

July 5, 2006

In an unpublished case, the US Court of Appeals for the Fifth Circuit ruled that a marine terminal on the Mississippi River is liable for damage to a ship caused by a collision between the ship and several barges that broke away from moorings at the terminal. The decision is unremarkable except to the controversy over the identification of the barges. Sycamore Management, Ltd. v. Unidentified Parties, No. 05-30271 (Source: HK Law)
